Terms & Conditions
Beast Philanthropy Beast Games Experience Donation Program (the “Program”) will begin on June 2, 2025 and ends when forty (40) charitable pledges to Beast Philanthropy of $100,000 each have been made and accepted, payment has been received, and each Potential Donor’s eligibility has been verified, or at 11:59:59 PM Eastern Time (“ET”) on June 16, 2025, whichever occurs first (the “Program Period”). Sponsor reserves the right to end the Program Period at any time. This Program is subject to all federal, state and local laws and regulations. The Program is sponsored by MrCharity, Inc, 740 SE Greenville Blvd. Ste 400-229, Greenville, NC 27858, USA (“Sponsor”). Sponsor is a 501(c)3 charitable organization. Employees (including anyone who has been employed by any of the following entities in the last two (2) years), officers and directors of Sponsor, MrBeastYouTube, LLC, and their respective parent companies, affiliates, subsidiaries, advertising, fulfillment and marketing agencies involved in this Program (collectively, the “Program Entities”), and the immediate family members, and/or those living in the same household of each are ineligible to pledge, donate and or take part in the “Experience” (as defined below).
ELIGIBILITY: Pledges may be made and donations will only be accepted from individuals who (1) are at least 18 years of age (each, a “Potential Donor”); and (2) are not a resident of a jurisdiction under U.S. embargo, export controls or sanctions, which include Belarus, Burundi, Cuba, Democratic Republic of the Congo, Iran, Myanmar, Central African Republic, North Korea, Russia, Syria, and Venezuela. Program is void where prohibited.
HOW TO PLEDGE TO DONATE: During the Program Period, Potential Donors must visit www. beastphilanthropy.org/vip-experience (the “Website”) and follow the on-screen instructions to pledge to donate $100,000 to Sponsor by completing the pledge form by providing their first and last name, a valid email address, their complete telephone number, country of residence and any other information requested (the “Pledge”). By submitting a pledge, a Potential Donor will be required to acknowledge: 1) their pledge to donate $100,000 to Beast Philanthropy within the time frame set forth herein; 2) that only the first forty (40) eligible verified pledges submitted via the Website will be accepted and be able to take part in the Experience; 3) that a Potential Donor is not a confirmed donor (“Confirmed Donor”) until/unless their pledge has been accepted by Sponsor, payment has been received, and such Potential Donor’s eligibility has been verified; and 4) that they have had the chance to review, and agree to be bound by, the Program Terms and Conditions (the “Terms”) and Privacy Policy. Upon submission of the Pledge, Sponsor will confirm eligibility of each Potential Donor in the order that Pledges were received via the Website. Sponsor’s clock is the official timekeeping device for this Program. All information submitted is subject to verification at any time and for any reason. Sponsor reserves the right, in its sole and absolute discretion, to require proof of additional supporting documentation (in a form acceptable to Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying a Potential Donor’s eligibility to participate; (ii) for the purposes of verifying the eligibility and/or legitimacy of any information submitted (or purportedly submitted); and/or (iii) for any other reason Sponsor deems necessary, in its sole and absolute discretion. Failure to provide such proof to the complete satisfaction of Sponsor within the timeline specified by Sponsor may result in disqualification in the sole and absolute discretion of Sponsor.
When a Pledge is accepted by Sponsor, the Potential Donor will receive a confirmation email with information on how to make payment of the $100,000 donation and execute, have notarized and return an affidavit, a liability release, and a publicity release (“Release”). Sponsor reserves the right to disqualify any Potential Donor whose payment and Release is not received within forty-eight (48) hours of receipt of notification. Only once a Potential Donor’s full payment is received by Sponsor will the Potential Donor be deemed a Confirmed Donor. If full payment and the Release is not returned within the specified time-period, notification is returned as undeliverable, Sponsor is unable to contact a Potential Donor, or a Potential Donor is not in compliance with these Terms, the ability to be named a Confirmed Donor and participate in the Experience may be forfeited. Sponsor reserves the right to waive any requirements set forth herein in its discretion. Sponsor and all other Program Entities shall have no liability for any Potential Donor notification that is lost, intercepted or not received for any reason. Sponsor is not responsible for lost, late, or misdirected email by a Potential Donor. If a Potential Donor is found to be ineligible in Sponsor’s sole discretion, or if they have not complied with these Terms or decline the Experience for any reason, such Potential Donor will be disqualified.
Experiences will only be awarded to eligible Potential Donors who participate in the Program in accordance with these Terms and all instructions of Sponsor. A maximum of forty (40) Pledges will be accepted and a maximum of forty (40) Experiences will be awarded. For all Pledges received which were not eligible for the Experience in accordance with these Terms, Sponsor will notify you via the email address provided in the Pledge. Any Potential Donor who submits a Pledge that is not accepted and/or does not consummate payment will have no financial obligation to Beast Philanthropy in any manner.
By accepting the Experience, Confirmed Donors acknowledge and agree that they and each of their guests (or their parent or legal guardian if a minor) may be required to sign non-disclosure agreements and/or additional releases on location at the Beast Games set. Additional restrictions may be required on site.
In the event the Experience does not take place for any reason, an alternate experience of a similar nature will be provided as determined by Sponsor in its sole discretion.
No warranty or guarantee, either express or implied is provided by Sponsor. Confirmed Donors may not substitute, assign or transfer the Experience.
EXPERIENCE: Up to forty (40) Experiences are available. Each Experience consists of the following for the Confirmed Donor and up to two (2) guests:
- Access to the Greenville, NC set of the new Season of Beast Games including a private Q&A with the production team.
- Behind-the Scenes access with members of the Beast Games team.
- The opportunity to volunteer alongside the Beast Philanthropy team at the local food pantry in Greenville, NC.
- A two (2) night stay at a Sponsor selected hotel in Greenville, NC (up to two rooms).
- All meals throughout the Experience.
- Private ground transportation throughout the Experience.
- Beast-branded merchandise and gifts.
(Items 1 through 7 above are collectively referred to herein as, the “Experience”).
The Experience does not include transportation to/from Greenville, NC, which must be booked by Confirmed Donors. While we can't guarantee a personal meet-and-greet with MrBeast due to scheduling and production constraints, we’ll do our best to make it an unforgettable experience. Any expenses not set forth herein, including souvenirs, incidentals, gratuities, phone calls, travel insurance are the sole responsibility of the Confirmed Donors and/or guests.
Sponsor will provide private ground transportation from either Raleigh, NC or Greenville, NC airport to the Experience. Potential Donors must participate in the Experience on the dates designated by Sponsor (currently scheduled from June 27 – 29, 2025) or they will forfeit the opportunity to participate in the Experience. Dates are subject to change at Sponsor’s sole discretion.
All Experience details are at the sole discretion of the Sponsor. As detailed above, Confirmed Donor may bring up to two(2) guests, but Confirmed Donor cannot otherwise assign or transfer the Experience to another person without the express permission of Sponsor. No cash alternative is allowed. If the Confirmed Donor is unable or unwilling to accept the Experience, or any portion thereof, as stated, the Experience, or that portion thereof, may be forfeited in its entirety at the sole discretion of Sponsor. Save for liability for death or personal injury due to Sponsor’s gross negligence or willful misconduct, Confirmed Donor and their guests agree that they undertake the Experience at their own risk. Sponsor is not liable for any expenses incurred, or any portion of the Experience missed, as a consequence of travel delays. Sponsor reserves the right to structure the Experience in its sole discretion.
The fair market value (FMV) will be communicated to confirmed donors at a later date. Confirmed Donor’s guests must also sign and return an affidavit, liability and publicity release to Sponsor prior to participation in the Experience. Minor guests must be accompanied by a parent/legal guardian who must sign all applicable documents on their behalf.
In the event a Confirmed Donor and/or their guest(s) engage in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is obnoxious or inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the Experience early, in whole or in part, and require the Confirmed Donor and/or their guest to leave the Experience with no further compensation being paid in exchange therefore.
Subject to applicable law, confirmed Donors and their guests (and their respective parents or legal guardians, if applicable) may be photographed, videotaped and otherwise recorded by Sponsor during the Experience (collectively, "Footage"). Footage will be owned by Sponsor who has the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names and likenesses embodied therein, in any and all media now known or hereafter devised throughout the world, in perpetuity, in connection with publicity regarding the Experience, Sponsor or MrBeast. By participating in the Experience, subject to applicable law, Confirmed Donors and their guests (via their parent/legal guardian if a minor) grant permission for Sponsor and its designees to use such person’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation in connection with publicity regarding the Experience, Sponsor or MrBeast.
CONDITIONS OF PARTICIPATION: Potential Donors shall indemnify, defend and hold harmless the Program Entities and each of their directors, officers, employees, interns, shareholders and contractors (collectively, the “Released Parties”) from and against any and all liability, claims, loss, damage, injury or expense, including reasonable outside attorneys’ fees, arising out of or in connection with any third-party action arising out of or resulting from (i) participation in the Program and/or (ii) the Experience, including without limitation, personal injury, death and property damage arising therefrom and any travel related thereto. These Terms are subject to modification by Sponsor at any time. In the event of a dispute, all decisions made by Sponsor are final and binding. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Program or Experience (or any portion of the Program or Experience) if, for any reason, the Program or Experience is not capable of completion as planned, including, without limitation, should a virus, bug, computer problem, unauthorized intervention or other cause or problem corrupt or inhibit participation in the Program or Experience. Sponsor may prohibit an otherwise eligible Potential Donor from participating in the Program or being named a Confirmed Donor if, in its sole discretion, it determines that such Potential Donor poses a security threat and/or is attempting to undermine the legitimate operation of the Program by cheating, deception, or any other unfair practices or intending to annoy, abuse, threaten or harass any other Potential Donors or Sponsor's representatives.
All Pledges must be received in accordance with the deadline stated herein in order to participate. The Website’s database clock will be the official timekeeper for pledge submissions. In the event a dispute regarding the identity of the individual who actually submitted a Pledge cannot be resolved to Sponsor’s satisfaction, the affected Pledge will be deemed ineligible. The Program Entities shall not be responsible for incorrect or inaccurate information contained in a Pledge submission whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Program or by any technical or human error which may occur in the submission or processing of the Pledges in the Program. The Released Parties assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of Pledges or any information provided in connection therewith.
By participating in the Program, each Potential Donor expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information in accordance with the Sponsor’s privacy policy (available at: https://www.beastphilanthropy.org/privacy-policy). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
GOVERNING LAW: To the fullest extent permitted by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms or the rights and obligations of Potential Donors, Confirmed Donors or Sponsor in connection with the Program shall be governed by and construed in accordance with the internal laws of the State of New York, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. Any and all disputes relating to this Program shall be brought within the federal, state and local courts within New York, New York.
BY PARTICIPATING IN THE PROGRAM, POTENTIAL DONOR AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROGRAM, OR ANY EXPERIENCE, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00) (UNLESS PROHIBITED BY LAW, AND IF PROHIBITED BY LAW, THE MINIMUM AMOUNT ALLOWED UNDER LAW), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY POTENTIAL DONOR BE PERMITTED TO OBTAIN ANY AWARD FOR, AND POTENTIAL DONOR HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00) (UNLESS PROHIBITED BY LAW, AND IF PROHIBITED BY LAW, THE MINIMUM AMOUNT ALLOWED UNDER LAW), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) POTENTIAL DONOR REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND POTENTIAL DONOR IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A POTENTIAL DONOR, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE WEBSITE OR INTERFERE WITH THE OPERATION OF THE PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
